Family Immigration

Family-based immigration allows people already living in the U.S. to sponsor a relative who wants to come to the country. There are two types of family-based immigrant visas:

  • Immediate Relative – Immediate Relative Visas are for those with a close family relationship with a U.S. citizen, including spouses, children, and parents. There is no limit to the number of Immediate Relative Visas issued annually.
  • Family Preference – Family Preference Visas are for more distant relatives of U.S. Citizens and some specified relatives of Lawful Permanent Residents (LPRs). The U.S. limits the number of Family Preference Visas it issues during a fiscal year.

Citizens and LPRs who wish to sponsor a relative must be:

  • At least age 21
  • Able to prove a family relationship with the individual they sponsor
  • Able to prove they can financially support their family member as they adjust to life in the United States

Family-based visas also include marriage-based visas and visas for fiancés/fiancées. Knowing which forms to complete and how to file for family-based immigration correctly can be challenging. Our firm can help with every stage of the application.

Investor/Business

Foreign investors can apply for Immigrant Investor Visas. To be eligible, you must make a significant capital investment in a new commercial enterprise in the U.S. that helps create jobs.

Employment

According to the Department of State, the U.S. issues around 140,000 employment-based immigrant visas each fiscal year. To apply, you will need an employer to sponsor you.

Employment visas fall into the following categories:

  • EB-1 – EB-1 Visas are for workers with extraordinary abilities in the sciences, the arts, business, education, or athletics. These visas are also for outstanding researchers, professors, managers, and multinational executives.
  • EB-2 – You can apply for an EB-2 Visa if you have an advanced degree or exceptional abilities in the arts, the sciences, or business.
  • EB-3 – This type of visa is for professionals, skilled workers, and some unskilled laborers who are not performing temporary or seasonal work.
  • EB-4 – EB-4 Visas are for “special immigrants.” This category includes religious workers, U.S. Foreign Service employees, and retired employees of international organizations.
  • EB-5 – This category is for business investors.

Temporary worker visas are also available for those wishing to come to the U.S. for a set time to perform temporary or seasonal work.

DACA Renewals

DACA stands for Deferred Action for Childhood Arrivals (DACA). The program allows individuals brought to the United States as children to defer removal actions for two years, with the opportunity for renewal.

You may be eligible for DACA or a DACA renewal if you:

  • Came to the United States before age 16
  • You were under age 31 when DACA was enacted on June 15, 2012
  • Have resided continuously in the U.S. since June 15, 2012
  • Have no lawful immigration status
  • Are currently enrolled in school
  • Have graduated from high school in the U.S., obtained a GED, or are an honorably discharged veteran of the U.S. Armed Forces or Coast Guard

Naturalization

You can apply for U.S. citizenship via naturalization if you are already a Lawful Permanent Resident. However, this can be a complicated undertaking that requires you to correctly complete and file forms, submit medical and work information, and attend an in-person interview.

While there are other requirements, you must be at least 18 years old to apply for naturalization and have resided in the U.S. for at least five years (three if you are married to a U.S. citizen).
